Divorce is both a legal and emotional transition. For most couples, divorce involves questions about finances, children, property, and what the future will look like. For couples who have never dealt with the family court system before, everything can feel overwhelming as they try to figure out where to start and what comes next.ย
In California, there are specific rules that govern how you can dissolve a marriage. But one of the most important things to understand is that the state follows no-fault divorce laws, meaning a spouse does not have to prove wrongdoing to end the marriage. Instead, simply stating that the relationship has broken down beyond repair is sufficient to file for divorce.
At The Sands Law Group, our Los Angeles divorce lawyers help individuals and families navigate the California divorce process. Understanding your legal options and knowing what to expect can make the experience more manageable.
Understanding Divorce Laws in California
As mentioned earlier, California is a no-fault divorce state. You do not have to prove misconduct like adultery, abandonment, or abuse to file for divorce. Most divorces in California are based on whatโs called irreconcilable differences.ย
Now, even though California does not require a reason for divorce, there are still certain legal requirements you must meet. For example, at least one spouse must have lived in California for six months before filing. Additionally, that spouse must have lived in the county where the case is filed for at least three months.ย
Another significant rule to bear in mind is the mandatory six-month waiting period. Even if both spouses agree on everything and complete their paperwork relatively quickly, the divorce cannot become final until at least six months have passed from the date the other spouse was served with the divorce papers.ย ย
But you may have heard of someone who got their divorce finalized pretty fast. In some cases, couples may qualify for a simplified process known as summary dissolution, which is generally faster. However, strict eligibility requirements must be met. For instance, the marriage must be relatively short, the couple cannot have minor children, and their financial situation must fall within certain limits.ย
Your Legal Options for Divorce in California
Not every divorce follows the same path. Some couples can work through their differences and reach an agreement, while others need court intervention to resolve their disputes. Below are the key options available:
Uncontested Divorce
An uncontested divorce is one in which both spouses agree on all major issues. This includes matters such as property division, child custody arrangements, child support, and alimony.ย
Since the court does not have to hold a trial to decide these key issues, the judge typically reviews the agreement to ensure it follows California law and then approves it.ย
Contested Divorce
A contested divorce occurs when spouses disagree about one or more key issues that must be resolved before the marriage can legally end. Common disputes may involve how property should be divided, how debts accumulated during the marriage should be handled, who should keep the family home, child custody schedules, spousal support, child support, and parenting time.ย
Even if spouses disagree on just one issue, the case is still considered contested. When this happens, the court may need to intervene. This may involve several hearings and take longer to resolve.ย
Divorce Mediation
Another legal option is mediation. During mediation, a neutral third party works with both spouses by guiding discussions and helping them find practical solutions. The mediator does not make decisions for the couple. They just help spouses communicate and negotiate effectively.
Mediation can take place before the divorce is filed or at any stage during the process. If you can reach an agreement through mediation, you may complete your divorce as an uncontested case.
Collaborative Divorce
This is another alternative to litigation, in which both spouses agree to work together to settle their divorce out of court. Each spouse has an attorney, but the goal is negotiation and problem-solving rather than heated courtroom litigation.
However, collaborative divorce requires both spouses to cooperate in good faith; otherwise, unresolved issues may still end up before a judge.
Regardless of which option you choose, several legal issues must be addressed before a divorce can be finalized. These include:
- Division of marital property
- Child custody and parenting plans
- Child support
- Spousal support (alimony)
What to Expect During the Los Angeles Divorce Process
The following are the steps in a California divorce:
- Filing the Divorce Petition
The process begins when one spouse, the petitioner, files a petition for dissolution of marriage with the court. The other spouse is called the respondent. If the couple has minor children, the initial paperwork should also include information about the children and any proposed custody arrangements.ย
Itโs important to note that starting January 2026, couples who agree to cooperate may also file a joint petition. Here, both spouses submit the paperwork together, avoiding the formal service process
- Serving the Divorce Papers
If you do not use a joint petition, the respondent must be formally served with the divorce papers. Another adult, other than you (the petitioner), such as a sheriff, delivers the documents.
- Responding to the Petition
Once served, the respondent typically has 30 days to file a response and submit the required paperwork to the court.
- Exchanging Financial Disclosures
California law requires both spouses to exchange financial information, including their income, expenses, assets, and debts. These documents ensure transparency and help the court determine property division and support.ย
- Negotiation or Court Proceedings
Depending on the level of agreement, the case may proceed to settlement discussions, mediation, or court hearings.
- Final Judgment
Once all issues are resolved, the court issues a final judgment of dissolution, which legally ends the marriage.
